Seller guide · VA-backed home loans

Selling a home with a VA loan?

When a buyer asks to assume your VA-backed loan, keep buyer approval, your release from personal liability, and what happens to your VA entitlement as separate questions for the servicer.

General information only. The servicer and VA decide loan-specific eligibility, requirements, approval, release, and entitlement restoration. AssumableDesk helps organize preparation materials and does not guarantee an outcome.

Understand the distinction

A buyer’s approval does not answer every seller question.

VA guidance describes assumption approval, liability release, and entitlement substitution as connected parts of the process with different effects. Ask what has been approved and what has been confirmed for your loan.

Buyer assumption approval

Confirm the buyer’s request was approved.

VA Circular 26-23-10 describes conditions for an assumption, including a current loan, the buyer agreeing to assume full liability, and creditworthiness under VA standards. The servicer or VA determines whether the specific application meets the applicable requirements.

Release from personal liability

Ask for the release in writing.

The VA form itself names assumption approval “and/or” release from personal liability. Ask the servicer which written decision or closing record confirms your release; do not treat an approval update alone as confirmation that this separate question is complete.

Entitlement substitution and restoration

Ask whether substitution applies to this buyer.

An eligible Veteran buyer who intends to occupy the home and has sufficient entitlement may agree to substitute their entitlement for the seller’s. VA guidance describes restoration for the seller through that substitution path. Without applicable substitution, VA Circular 26-23-10 says the seller’s original entitlement remains encumbered by the loan until it is paid in full, with no restoration through that path.

Preparation guidance

A seller’s four-step assumption file.

Use this list to organize questions and follow-ups. It is not a loan-specific determination or a substitute for the servicer’s current instructions.

  1. 01

Record the loan and servicer details

Keep the servicer’s name and contact details, the loan number, the current loan status, and the date you opened the assumption discussion together. Store account details securely.

The CFPB describes a loan assumption as a buyer taking over the seller’s mortgage balance on its existing terms. That is general consumer guidance, not a VA loan decision.

  2. 02

Ask the servicer what applies now

Request the current application and document list, how to check review status, what written decision or closing record confirms your release from personal liability, and which buyer-entitlement or substitution requirements apply if the buyer asks to substitute entitlement.

VA Form 26-6381 is general source material for assumption approval and/or release from personal liability. Confirm the current form and instructions with the servicer or VA before submitting anything.

  3. 03

    Track submissions and follow-ups

Keep copies of what was sent, when and how it was sent, any receipt or reference number, the person or team handling the review, and each follow-up and response. Ask the servicer what is still outstanding instead of assuming a file is complete.

VA Circular 26-23-10 describes assumption processing roles and application handling. The servicer can tell you which current steps apply to this loan.

  4. 04

    Get the outcomes in writing

Keep the written assumption decision and any release-of-liability confirmation. If entitlement substitution or restoration is part of the request, get written confirmation of that outcome too before treating either item as complete.

VA guidance describes different entitlement results with and without substitution. The servicer and VA decide and confirm the result for a specific loan.
